HB 322 would add religious liberty to the list of exceptions in the Governmental Immunity Act of Utah.

The bill states that the lawful and proper exercise of religious liberty and rights of conscience do not constitute nor shall they be applied in such manner as would result in wrongful discrimination under other laws and statutory protections.

The law allows a person whose lawful and proper exercise of religious liberty has been substantially burdened in violation of this law to obtain appropriate relief in a judicial proceeding.

If passed, the bill would allow individuals, businesses, and others to discriminate against anyone under the guise of religious liberty.
