HB 1890 provides for the final disposition of fetal remains; and imposes penalties.

Requirements

The bill would require a health-care facility that possesses fetal remains to provide for the final disposition of any such remains in accordance with the burial and transit permit requirements under state law. The facility would be required to cremate or inter the fetal remains.

If the pregnant patient who had a miscarriage of abortion at a health-care facility selects a location for the final disposition of the fetal remains other than a location that is “usual and customary” for a health-care facility, the parent would be responsible for any related costs.

The bill would not require the person responsible for interment to identify or designate a name for the fetal remains on the burial or transit permit.

If any fetal remains are not claimed by a parent, the person in charge of internment my cremate the fetal remains by simultaneous cremation.
