SB 2305 requires that physicians who perform abortions be licensed in the state of North Dakota and imposes a medically unwarranted requirement that physicians have admitting privileges at a local hospital.

Physicians who fail to comply with the admitting privileges requirement could be prosecuted for a Class A misdemeanor, which is punishable by up to a year in prison and a $3,000 fine.

The bill amends North Dakota Century Code § 14-02.1-04.

STATUS

This bill was temporarily blocked by a federal court pending resolution of the litigation. (See MKB Management Corp.  v. Burdick (2011).)
