This law was last updated on Mar 23, 2018
SB 2616 would ban abortions on a pregnant person seeking the abortion solely because of a prenatal diagnosis indicating Down syndrome or the potential of Down syndrome in the fetus.
Any physician or other person who performs or induces or attempts to perform or induce such an abortion would be guilty of a felony and, upon a conviction, be fined up to $25,000.00 and/or imprisoned for up to two years.
The attending physician would be required to certify in an individual abortion report that they did not have any knowledge that the pregnant person sought the abortion solely because of a prenatal diagnosis, test, or screening indicating Down syndrome or the potential of Down syndrome in a fetus.
