SB 329 would establish the right of a pregnant woman who has an abortion to determine the final disposition of the aborted fetus. The bill would charge the state department of health with determining appropriate methods of disposal.

SB 329 would require that a pregnant woman be informed orally and in writing before an abortion:

  • that the pregnant woman has a right to determine the final disposition of the remains of the aborted fetus;
  • of available options for disposition of the aborted fetus; and
  • of available counseling services.

The bill would also change the definition of the term “fetus” to mean “an unborn child, irrespective of gestational age or the duration of the pregnancy.”
