SB 50 is an amendment added to the Indiana Religious Freedom Restoration Act (SB 101), in an attempt to provide protections for the LGBTQ community.

The amendment specifies that the RFRA does not authorize a provider to refuse to offer or provide services, facilities, use of public accommodations, goods, employment, or housing to any member or members of the general public on the basis of race, color, religion, ancestry, age, national origin, disability, sex, sexual orientation, gender identity, or United States military service.

The amendment further specifies that the RFRA does not establish a defense to a civil action or criminal prosecution for such refusal by a “provider” on the basis of the previously stated characteristics.

The term “provider” is defined to mean one or more individuals, partnerships, associations, organizations, limited liability companies, corporations, and other organized groups of persons.

Nonprofit religious organizations and clergy members would be exempt.
