Ted Cruz Targets Federal Policy Protecting Abortion Providers, Patients

Sens. Ted Cruz (R-TX) and Mike Lee (R-AZ) have probed the U.S. Department of Justice (DOJ) to provide documentation about complaints under a federal law that protects access to reproductive health-care providers and houses of worship.

Cruz and Lee, members of the Senate Judiciary Committee, gave Attorney General Loretta Lynch an April 11 deadline to comply with a request for information about the Freedom of Access to Clinic Entrances (FACE) Act enforcement for abortion care facilities and places of worship.

The FACE Act, which became law in 1994, makes it a federal crime to use force, the threat of force, or physical obstruction to prevent people from obtaining or providing reproductive health-care services. The statute also provides civil remedies for blocking access to abortion care facilities, including fines against those found liable.

Cruz and Lee claimed in a letter to the attorney general that Lynch, during a committee hearing this month, “discussed the DOJ’s ‘active’ and ‘increased’ efforts to enforce FACE with respect to interference with reproductive health services,” but failed to do so for houses of worship.

A Lee spokesperson told Rewire that the senator would make a decision about whether to call for a hearing after DOJ officials respond.

Under the Obama administration, the DOJ has prosecuted at least eight people every year under the FACE Act. Incidents of targeted clinic violence have steadily climbed in the aftermath of a series of heavily edited videos from an anti-choice front group falsely suggesting Planned Parenthood sells fetal tissue.
