The U.S. Supreme Court will hear arguments next week in two consolidated cases that could kill the birth control benefit for good. Trump v. Pennsylvania and Little Sisters of the Poor Saints Peter and Paul Home v. Pennsylvania are perfect examples of conservative efforts to game the legal system for a desired policy outcome—in this case, by creating a huge regulatory loophole for businesses, churches, colleges, and universities to ignore laws they don’t like. And taking center stage are the Little Sisters of the Poor, who have become some of the most prominent bad-faith actors in the fight over the birth control benefit. On top of it all, the Supreme Court oral arguments will be live-streamed for the first time in history.
