The American Civil Liberties Union, ACLU of Alabama, and Planned Parenthood Federation of America filed a lawsuit on behalf of Alabama abortion providers challenging HB 314, a near-total abortion ban which criminalizes most abortions and punishes doctors with up to 99 years in prison.

Plaintiffs allege the law would essentially eliminate legal abortion in the state of Alabama and subject patients to “significant and  irreparable harm to their constitutional rights for which no adequate remedy at law exists.”

Plaintiffs allege the law violates the rights to liberty and privacy guaranteed by the Due Process Clause of the Fourteenth Amendment to the United States Constitution.

Status

On October 29, 2019, U.S. District Court Judge Myron Thompson issued a preliminary injunction blocking the law.
