Washington Bill Regarding Wrongful Birth and Wrongful Death (SB 5747)

SB 5747 would prohibit a person from filing a lawsuit or receiving a damages award for wrongful birth or wrongful life based on the claim that, but for an act or omission of another person, the person (or a child) would not or should not have been born.
This would apply regardless of whether the person or child is born healthy or with a birth defect or other adverse medical condition.
SB 5747 would also expand the list of beneficiaries in wrongful death actions. A parent or parents of the deceased may maintain an action “for the loss of the society and companionship of the deceased person and for the destruction of the parent-child relationship.” A personal representative of the decedent would be able to recover damages if there were no parents qualified to maintain such an action.
Reintroduced and retained in present status on April 29, 2015 which means it will be live in the next legislative session.
