HB 2802 would make it a Class B misdemeanor for an individual to enter a public bathroom, locker room, or shower facility that is designated for use by persons of a sex that is not the same sex as the individual’s biological sex.

An individual who violates the law would be liable to a person who encounters the individual in the public bathroom, locker room, or shower facility. Should the individual prevail in court, they would be awarded exemplary damages in the amount of $2,000, actual damages, court costs, and reasonable attorney’s fees.

The law would allow exceptions for custodial and maintenance staff, those providing medical assistance, and parents accompanying children under the age of five or with special needs.
