Texas Bill Amending Law Regarding Informed Consent of a Minor (HB 3765)

HB 3765 would amend existing informed consent law (Health and Safety Code § 171.001) and prohibit anyone from performing an abortion without the voluntary and informed consent of the pregnant woman, “regardless of the age of the woman,” on whom the procedure is to be performed. (The bill would add the phrase “regardless of the age of the woman.”)
The bill would prohibit an abortion from being performed on an unemancipated minor without the written notarized consent of the minor and the minor’s parent or guardian unless the physician determines it is necessary to prevent the death or to avoid serious risk of substantial impairment of a major bodily function.
Existing law states that consent must be written, but doesn’t mention that it must be notarized.
