South Dakota Bill Requiring Policy on the Use of School Facilities by Transgender Persons (HB 1296)

HB 1296 would require the school board of each public school district in the state to establish and make available to the public a policy regarding the use of the bathrooms and locker rooms located in schools within the school district by any transgender person.
The bill defines “transgender person” to mean “a person whose gender identity does not match the person’s biological sex assigned at birth.”
The bill defines “biological sex” to mean “the physical condition of being male or female as determined by the person’s chromosomes and anatomy as identified at birth.”
The bill does not indicate the type of policy a school board should establish. However, a few of the bill’s sponsors are currently sponsoring, and have previously sponsored, anti-transgender legislation.
