HB 4146 would require a physician who determines that the probable gestational age of a patient’s fetus is 19 or more weeks to perform an abortion on that patient only in a hospital that has a neonatal unit. Prior to performing the abortion, the physician would be required to establish the protocol to be followed consistent with section 3 of the Born Alive Infant Protection Act.
