HB 73 would charge pregnant people with “second degree cruelty to juveniles” if they are found to have used a controlled substance while pregnant.

The bill would charge a pregnant person with second degree cruelty to juveniles if they are found to have used a substance in violation of the Uniform Controlled Dangerous Substance Law, which results in any of the following:

  • Observable and harmful effects to the physical appearance or functioning of the newborn; or
  • The presence of a controlled dangerous substance found in the newborn that is not the result of medical treatment.
