Delaware ‘Woman’s Ultrasound Right to Know Act’ (HB 53)

HB 53 would require a physician to offer a pregnant patient ultrasound imaging and auscultation of fetal heart tone services before terminating a pregnancy, except in the case of an emergency. The patient would be free to choose not to view the ultrasound or listen to the heartbeat.
Prior to the performance of an abortion, a physician would be required to obtain the patient’s signature on a form indicating that the patient was offered ultrasound image and auscultation services.
A physician who fails to conform to any of these requirements would be guilty of a class A misdemeanor, and be subject to civil malpractice and professional disciplinary action.

Identical to SB 240, which failed to pass in 2018.
