SB 298 would allow for the burial or cremation of a fetus following a spontaneous fetal demise.

The bill defines “spontaneous fetal demise” to mean “the death of a fetus that occurs prior to a gestation period of twenty weeks.”

The bill would require a hospital that has custody of a fetus following a spontaneous fetal demise to notify the mother of the fetus in writing of their right to arrange for burial or cremation of the fetus. The mother would have 24 hours after being notified to elect, in writing, to arrange for the burial or cremation of the fetus.
